Terms of Service
These terms cover how we plan, book and invoice your trip, and how the planning work we produce is protected. They apply to all services provided by Aluna Holdings Ltd operating under the brand name "Explore with Makks".

1. Who we are
Aluna Holdings Ltd, a company registered in Kenya and operating under the brand name "Explore with Makks", provides travel consulting, itinerary curation and ground logistics coordination. In these terms, "we", "us" and "the Company" mean Aluna Holdings Ltd trading as Explore with Makks, and "you" or "the Client" means the person or party engaging our services.

2. Our role
We act as a travel planner and coordinator. Accommodation, transport, rail, flights, guides, entries and activities are delivered by independent third-party suppliers under their own terms and conditions. We select, negotiate, book and manage those suppliers on your behalf, and we remain your single point of contact before and during travel.
We are not liable for acts, omissions, delays, closures, mechanical failures, weather events, health incidents or any other matter within the control of a third-party supplier or outside reasonable human control. We will always work to find a practical alternative when something changes on the ground.
3. Quotations, fees and payment
All quotations and invoices are issued in Kenyan Shillings (KES). Supplier costs are shown as they are, and our service charge of 20% on the trip subtotal appears as a separate line on every invoice. Quoted rates are indicative until confirmed in writing and may change if supplier availability, taxes or park and entry fees change before booking.
A non-refundable commitment fee is required to begin securing your trip. It is credited in full toward your trip total. Time-sensitive items such as rail allocations, domestic flight blocks and peak-season rooms may be invoiced in full at the point of booking.
Remaining balances are due 30 days before travel, or on the schedule stated on your invoice for late bookings. Payment can be made by M-Pesa or bank transfer in KES. Where you pay from outside Kenya, please instruct your bank to remit Kenyan Shillings so conversion charges do not create a shortfall. Any shortfall remains payable by the Client.
Unpaid balances may result in the release of held bookings. Payments already made to suppliers are subject to those suppliers' cancellation terms.
4. Proprietary itineraries and non-circumvention
Every itinerary, routing plan, day-by-day schedule, supplier selection, costing sheet, rate structure, logistics plan and written recommendation we produce is proprietary work product of Aluna Holdings Ltd operating under the brand name "Explore with Makks". It is shared with you for the sole purpose of planning and taking the trip we are engaged to arrange. It remains our intellectual property.
You agree not to copy, publish, resell, distribute or share our itineraries, costings or supplier lists with any third party, including other travel agencies, tour operators or planners, without our prior written consent.
Non-circumvention: for a period of twelve (12) months from the date an itinerary, quotation or supplier introduction is provided to you, you agree not to contract, book or engage directly, or through any other agent or intermediary, with any accommodation, transport provider, driver, guide, activity operator or other supplier introduced to you by us for the services described in that itinerary, without booking through us. This includes bookings made by members of your travelling party, family members, employees or associates who received the itinerary through you.
If a booking is made in breach of this clause, the Client agrees to pay the Company the service charge that would have applied to the circumvented services, calculated at 20% of the value of those services, as compensation for the planning work performed. This clause does not restrict travel you plan independently of our work, nor bookings with suppliers you already had an established relationship with before engaging us.
Nothing in this section prevents you from returning to a supplier for a future, unrelated trip after the twelve (12) month period has ended.
5. Changes and cancellations
Change requests after confirmation are subject to supplier availability and any supplier amendment fees, plus a coordination fee where the change requires material re-planning. We will always quote this to you in writing before acting.
Cancellations must be made in writing. Commitment fees are non-refundable. Refunds of other amounts are limited to whatever we are able to recover from suppliers under their cancellation terms, less our service charge on work already performed. We recommend comprehensive travel insurance covering cancellation, medical care, evacuation and baggage for every traveller.
6. Client responsibilities
You are responsible for valid passports, visas and eTAs, required vaccinations and health precautions, travel insurance, and for the accuracy of all names, dates, ages and dietary or medical information you give us. Corrections required because of inaccurate information may carry supplier fees.
You are responsible for the conduct of your party. Suppliers may refuse or end service for unsafe or unlawful behaviour, and no refund is due in those circumstances.
7. Privacy and confidentiality
We collect only what is needed to plan and deliver your trip, and we share details with suppliers strictly on a need-to-know basis. We do not publish client names, contact details, invoice numbers or payment information. Public examples of past trips on this website are anonymised. Your invoice and payment records are accessible only to you, using your invoice number and access code, and to authorised staff.
8. Liability
To the maximum extent permitted by Kenyan law, our total liability for any claim arising from our services is limited to the service charge paid by you on the affected booking. We are not liable for indirect or consequential loss, including loss of enjoyment, missed connections outside our control, or lost earnings.
9. Governing law
These terms are governed by the laws of Kenya. Disputes will first be addressed through good-faith discussion, and failing that, referred to the courts of Kenya. Where a signed client service agreement exists for a specific trip, that agreement takes precedence over these terms to the extent of any conflict.
10. Acceptance
Paying a commitment fee, approving an itinerary in writing or travelling on arrangements we have made constitutes acceptance of these terms. We may update these terms from time to time; the version in force at the date of your booking applies to that booking.
